    1.  Don’t Take the Bait, Step 6: Watch Out for the W-2 Email Scam

    The IRS, state tax agencies and the tax industry urge tax professionals and businesses to beware of a recent increase in email scams targeting employee Forms W-2.

    The W-2 scam – called a business email compromise or BEC – is one of the most dangerous phishing email schemes trending nationwide from a tax administration perspective. The IRS saw a sharp increase in the number of incidents and victims during the 2017 filing season.

    5.  e-Services Unavailable over Labor Day Weekend

    IRS will conduct annual Labor Day maintenance on numerous electronic systems beginning Saturday, Sept. 2 at 8:00 p.m. ET and ending Tuesday, Sept. 5 at 5:00 a.m. ET. The Transcript Delivery System, TIN Matching, e-file Application, ACA and Registration Services will not be operational during this timeframe.  Please refrain from accessing e-services to conduct business during this period.

    1.  Registration Deadline Is Aug. 15 for Las Vegas IRS Nationwide Tax Forum

    The standard registration rate for the upcoming IRS Nationwide Tax Forum in Las Vegas expires Tuesday Aug. 15. Tax professionals who register by the deadline pay $255 for the three-day event. After the deadline registrants will be charged $370.

    4.  Form 2290, Heavy Vehicle Highway Use Return, Is Due Aug. 31; IRS Webinar Helps You Prepare

    Federal highway use tax returns for truckers or owners of heavy highway vehicles are due, in most cases, at the end of this month.

    To help tax pros prepare these returns, IRS is offering “Reminders for Form 2290, Heavy Vehicle Highway Use Tax Return,” a web presentation on Aug. 15 and 16 at 2 pm ET or 11 am PT. The free, 30-minute presentation will cover federal highway use tax responsibilities, best practices for filing and obtaining IRS-stamped Schedule 1, the advantages of e-filing Form 2290 and resources for the trucking industry.

    1.  Planned Outage for all e-Services Users

    The IRS is in the final stages of a technology upgrade for e-Services. Please plan ahead as there will be some temporary use issues that will occur as we make this transition:

    1. There will be a complete outage of all e-Services tools, including Registration, Transcript Delivery System (TDS), and TIN Matching, from 6 p.m. EDT, Thursday, Aug. 17, until 6 a.m. EDT, Monday, Aug. 21. Applications also will be offline and resume Aug. 22, except for state users. E-Services must be taken offline to complete the platform transition and to perform testing. This outage will affect all users, including bulk users such as IVES and TIN Matching.

    2. All State tax agency users will be unable to submit new e-file and TDS applications for state coordinators or change existing e-file and TDS applications for state coordinators from Aug. 17 until late October. This temporary issue will not affect state access to transcripts. If there is a critical need to add or remove an individual from a state application, states may contact their IRS government liaison representative who will notify appropriate IRS personnel.

    3. Affordable Care Act Information Return (AIR) filers may resume submission of applications for Transmitter Control Codes starting on Aug. 22. The application process for AIR users has been offline since July because of the e-Services platform transition.

    4. A redesigned e-Services landing page will launch Aug. 21.

    2.  Registration Deadlines Approaching for Washington, D.C., Las Vegas Nationwide Tax Forums

    Time is running out to register for the National Harbor (Washington, D.C.) and Las Vegas Nationwide Tax Forums. The standard rate of $255 expires two weeks before each Forum – Aug. 8 for National Harbor and Aug. 15 for Las Vegas. Registration after those dates will still be available but at a higher rate of $370. The National Harbor Forum is scheduled for Aug. 22-24, while the Las Vegas Forum takes place Aug. 29-31.

    Each IRS Nationwide Tax Forum offer practitioners continuing education seminars, case resolution and an exhibition featuring dozens of vendors and service providers. To register, visit irstaxforum.com.

    The Internal Revenue Service, state tax agencies and the tax industry today warned tax professionals to be alert to a new phishing email scam impersonating tax software providers and attempting to steal usernames and passwords.

    8.  Technical Guidance

    Notice 2017-41 extends issuer voluntary reporting for 2017 catastrophic coverage enrolled in through an Exchange.  In addition, issuers may rely on this notice to voluntarily report catastrophic plan coverage enrolled in through an Exchange for coverage years after 2017 to the extent final regulations requiring issuer reporting of catastrophic plan coverage enrolled in through an Exchange are not applicable.

    Notice 2017-41 will be in IRB 2017-34 dated Aug. 21.

    Notice 2017-42 announces that Treasury and the IRS intend to amend the section 871(m) regulations to delay the effective/applicability date of certain rules in those final regulations and extends the phase-in period provided in Notice 2016-76, 2016-51 I.R.B. 834, for certain provisions of the section 871(m) regulations.

    Notice 2017-42 will be in IRB 2017-34 dated Aug. 21.

    Beginning Aug. 1, the Internal Revenue Service Office of Appeals will pilot a new web-based virtual conference option for taxpayers and their representatives. This virtual face-to-face option will provide an additional option for taxpayer conferences. The IRS expects it to be especially useful for taxpayers located far from an IRS Appeals office.

    2.  Now Available: Public List of Certified Professional Employer Organizations

    The IRS has published a list of all certified professional employer organizations (CPEOs). The CPEO Public Listings Page is posted to IRS.gov.

    Under the Internal Revenue Code, a “certified professional employer organization” is an organization that applies to be certified as a CPEO and that the IRS has certified as meeting the applicable requirements, including timely filing a properly completed and executed Form 14751, Certified Professional Employer Organization Surety Bond.

    An organization is a CPEO as of the effective date of its certification and remains a CPEO until the IRS revokes its certification or, if earlier, until the CPEO voluntarily terminates its certification.

    3.  Increase to Special Enrollment Exam Fee Effective Next Year

    The IRS has issued final regulations which increase to $81 the IRS user fee for taking the Special Enrollment Examination (SEE) to become an Enrolled Agent.

    Here is a summary of the total fee amounts:

      •The current fee (effective for tests taken beginning May 1, 2017) for taking each of the three parts of the SEE is $111.94. This comprises $11 for IRS and $100.94 for the vendor.

      •Effective for tests taken beginning May 1, 2018, the fee for each part will be $181.94, comprised of $81 for IRS and $100.94 for the vendor.

      •Effective for tests taken beginning May 1, 2019, the fee for each part will be $184.97, comprised of $81 for IRS and $103.97 for the vendor.

    Note: The IRS encourages non-credentialed tax return preparers to take the SEE and become Enrolled Agents. The Return Preparer Office recently published a new brochure with further details, Pub. 5279, “Your Pathway to Becoming an Enrolled Agent Starts Here.”

    4.  IRS introduces email option for Direct Pay and the Electronic Federal Tax Payment System

    Your clients can now sign up for email notifications when using IRS Direct Pay or EFTPS to pay their taxes. This new email feature allows taxpayers to receive notifications about their payments in their personal email accounts.

    Your clients who use EFTPS can opt in to receive email notifications when they enroll or update their enrollments. Business clients making payments through a payroll service provider can also opt in to receive email notifications. If they opt in, they’ll receive email notifications for all payments made through EFTPS, including those made by their payroll service provider.

    Your clients who use Direct Pay can opt in to receive email notifications each time they make a payment.

    To protect taxpayers, there are no web links within the email notifications. To avoid phishing scams, if taxpayers see links in an email appearing to be from the IRS about payments, they shouldn't click on those links.

    Please share this information with clients who use these IRS payment options.

    6.  Reminder: W-2 and W-3 Filing Requirements

    The Protecting Americans from Tax Hikes (PATH) Act requires employers to file Forms W-2 and W-3 with the Social Security Administration by Jan. 31, whether filing paper forms or electronically.

    The law also requires that Form 1099-MISC, when reporting non-employee compensation payments in Box 7, be filed with the Internal Revenue Service by Jan. 31.

    Notice 2017-40 amplifies Notice 2015-77, 2015-47 I.R.B. 676, with respect to the Treasury Department’s Housing Finance Agency Innovation Fund for the Hardest-Hit Housing Markets (HFA Hardest Hit Fund) by extending through 2021 the safe harbor method for computing a homeowner’s deductions for payments made on a home mortgage and the relief for mortgage servicers and state housing finance agencies (State HFAs) from penalties relating to information reporting.  In addition, this notice amplifies Rev. Proc. 2011-55, 2011-47 I.R.B. 793, by extending its scope and effective date through calendar year 2021 for the HFA Hardest Hit Fund.

    The IRS, state tax agencies and the tax industry warn tax professionals to beware of spear phishing emails, an increasingly common tactic used by cybercriminals to target practitioners.

    Spear phishing emails, which are often tailored to individual practitioners, result in stolen taxpayer data and fraudulent tax returns filed in the names of individual and business clients.

    Information about spear phishing kicks off a new “Don’t Take the Bait” awareness campaign. This is the first of a special 10-part series that will run each week through mid-September.

    4.  Upcoming Modernized e-File System Maintenance

    The Modernized e-File (MeF) Production and Assurance Testing Systems (ATS) will be unavailable on Saturday, July 22 and again on Saturday, Aug. 5. The IRS will conduct system maintenance on these two Saturdays from 7:00 a.m. until 7:00 p.m. ET. Please refrain from accessing the MeF Production and ATS Systems to transmit submissions, get acknowledgements, retrieve state submissions, send state acknowledgements or submit any other service requests during these times.

    5.  Technical Guidance

    Revenue Procedure 2017-43 revises procedures for applying for Treasury Department approval of a suspension of benefits under a multiemployer defined benefit pension plan that is in critical and declining status under section 432(e)(9). Effective for applications submitted on or after Sept. 1, 2017, the revenue procedure modifies and supersedes Rev. Proc. 2016-27 and is intended to facilitate the Treasury Department’s review in light of its experience in processing benefit suspension applications.

    1.  July 11 Marks End of Early Registration for Dallas IRS Tax Forum

    Tax professionals interested in attending the IRS Nationwide Tax Forum in Dallas can save $115 by registering by July 11.

    Enrolled agents, certified public accountants, certified financial planners, Annual Filing Season Program participants and other tax professionals can register at the standard rate of $255 through July 11, but attendees registering after that date or on-site will pay $370.

    The Dallas IRS Nationwide Tax Forum takes place July 25-27.

    The daily schedule lists a wide variety of seminars ranging from identity theft prevention, to understanding business returns, to issues in exam and collection, to the IRS future state.

    2.  Security Summit Launches “Don’t Take the Bait” Campaign

    The IRS warns tax professionals to increase their computer security and to beware of their inbox – specifically the successful email scams dubbed spear phishing that are disguised to look as if they come from a friend, a customer or a company.

    The 10-week campaign begins July 11, coinciding with the opening of the first IRS Nationwide Tax Forum in Orlando, Fla., and ends Sept. 12 with the final Nationwide Tax Forum in San Diego.

    3.  IRS Launches 2017 Summertime Tax Tip Program

    More than 719,000 taxpayers received plain-language Tax Tips directly to their email inboxes during this past tax filing season and got information to help them file their taxes.

    Because taxes are year-round for many taxpayers, and many taxable situations arise during the summer months, the Internal Revenue Service offers a Summertime Tax Tip program that began July 3. The IRS is encouraging taxpayers to sign up now for this email service to help them get a jump-start on their taxes and learn about the tax implications of events that often occur during the summer months.

    1.  e-Services, Transcript Delivery System Unavailable Memorial Day Weekend

    The IRS will conduct systems maintenance beginning Friday, May 26, 2017 at 6 p.m. EDT and ending on Tuesday, May 30, 2017 at 5 a.m. EDT. During this time, e-Services Transcript Delivery System, TIN Matching, e-file and ACA applications will not be available.

    Mark your calendars for June: E-Services also will be unavailable from Thursday, June 15 at 6 p.m. through Monday, June 19 at 6 a.m. as it moves to a different platform as part of a technology upgrade. All applications – including the Transcript Delivery System and TIN Matching – will be offline during this timeframe.

    2.  Opportunity Coming to Participate in New Correspondence Examination Digital Pilot Program

    The IRS Taxpayer Digital Communications (TDC) Secure Messaging pilot program has started with correspondence examinations involving Schedule A and has expanded to include some other issues. During the pilot the IRS will invite approximately 8,000 taxpayers under correspondence examinations to communicate with the Service using secure messaging through digital communication channels.

    The pilot program is by invitation only. Taxpayers and their tax professionals with valid powers of attorney (POA) can participate only if the client receives a marketing insert or letter saying they are eligible.

    If your client is invited, encourage him or her to volunteer for this pilot program. Your POA must already be on file and showing on the Centralized Authorization File (CAF) system before you as a tax professional can participate.

    After your client receives an invitation and registers via IRS Secure Access, you must also authenticate via IRS Secure Access under your own SSN and complete the “Request Access” verification process. After IRS verifies the POA is authorized, you will have access to your own secure message mailbox in TDC to receive copies of messages and communicate with IRS.

    3.  Deadline for the Information Reporting Program Advisory Committee (IRPAC) is May 21

    The Internal Revenue Service is accepting applications for the IRPAC through May 21, 2017. IRPAC provides recommendations to the IRS on various tax administration issues. All applicants must complete and submit an application, tax check waiver form, and resume.

    4.  Tax Pros Can Earn 18 CPE Credits at the 2017 IRS Nationwide Tax Forums

    The IRS encourages tax professionals to register for the 2017 IRS Nationwide Tax Forums for an opportunity to earn up to 18 continuing professional education credits at any of the five forums held throughout the country beginning this July. Tax professionals who register by May 31 qualify for an early-bird rate of $235.

    Revenue Ruling 2017-12 provides various prescribed rates for federal income tax purposes including the applicable federal interest rates, the adjusted applicable federal interest rates, the adjusted federal long-term rate, the adjusted federal long-term tax-exempt rate. These rates are determined as prescribed by Sec. 1274.

    Revenue Procedure 2017-38 modifies Rev. Proc. 2017-3, 2017-1 I.R.B. 130, which sets forth areas of the Internal Revenue Code on which the Internal Revenue Service will not issue letter rulings or determination letters. It will appear in IRB 2017-22 dated May 30.

    Notice 2017-31 provides guidance on the corporate bond monthly yield curve, the corresponding spot segment rates used under Section 417(e)(3), and the 24-month average segment rates under Section 430(h)(2) of the Internal Revenue Code. Notice 2017-31 will be in IRB 2017-22, dated May 30.

    Revenue Procedure 2017-35 provides guidance with respect to the United States and area median gross income figures that are to be used by issuers of qualified mortgage bonds, as defined in § 143(a) of the Internal Revenue Code, and issuers of mortgage credit certificates, as defined in § 25(c), in computing the housing cost/income ratio described in § 143(f)(5).

    Revenue Procedure 2017-35 will be in IRB 2017-21, dated May 22.

    Revenue Ruling 2017-09 provides guidance regarding the federal tax treatment of certain transactions referred to as ‘north-south’ transactions. The guidance describes two north-south transactions:  one involving steps that are respected as separate and another involving steps that are integrated.

    Revenue Ruling 2017-09 will be in IRB 2017-21, dated May 22.

    Revenue Procedure 2017-36 provides indexing adjustments for certain provisions under sections 36B and 5000A of the Internal Revenue Code.  In particular, it updates the Applicable Percentage Table in § 36B(b)(3)(A)(i) to provide the Applicable Percentage Table for 2018.  This table is used to calculate an individual’s premium tax credit.  This revenue procedure also updates the required contribution percentage in section 36B(c)(2)(C)(i)(II) for plan years beginning after calendar year 2017.  The percentage is used to determine whether an individual is eligible for affordable employer-sponsored minimum essential coverage under § 36B.

    Revenue Procedure 2017-36 will be in IRB 2017-21, dated May 22.

    Notice 2017-30 provides 180-day emergency relief for fuel removals from Milwaukee terminals due to the shutdown of the West Shore Pipeline.  Once the 180-day emergency relief expires, the notice provides a temporary mechanism for refunds of the § 4081(a)(1) tax imposed upon removals of undyed diesel fuel from a Milwaukee terminal when such fuel is transported to and entered into a Green Bay terminal and subsequently removed from that Green Bay terminal as dyed fuel destined for a nontaxable use.   Notice 2017-30 will be in IRB: 2017-20, dated May 15.

    Revenue Procedure 2017-37 provides the 2018 inflation adjusted amounts for Health Savings Accounts (HSAs) as determined under section 223 of the Internal Revenue Code.
